Shift to Employment
Barcelona in 2015 and now under Delivery Hero, initially resisted full compliance but ultimately reversed course in December 2024. The platform announced the formal employment of around 14,000 to 15,000 riders across Spain, citing the need to eliminate “legal uncertainties.” The change is expected to reduce Delivery Hero’s 2025 EBITDA by approximately €100 million. Glove previous resistance led to fines totaling over €200 million and an ongoing legal investigation into co-founder Oscar Pierre. France 24+5France 24+5La Vanguardia+5
Despite this, a Barcelona commercial court recently ruled in Glove favor in a €295 million unfair-competition lawsuit from Just Eat, stating the mobility and autonomy of riders still satisfy the legal definition of freelancers. However, the case underscores the complexity of Spain’s evolving labor landscape. El País+15El País+15France 24+15
Just Eat: A Case of Early Compliance
Just Eat anticipated the Rider Law back in 2021 and transitioned to employing its couriers. By mid-2025, it had approximately 2,500 riders on salaried contracts, enjoying legal protections from the start.
Uber Eats: A Hybrid Model Under Scrutiny
Uber Eats maintains a mixed model: some couriers are employed through subcontractors while others work as autonomous. As of July 2025, Spain’s Labor Inspectorate has opened an investigation for alleged non-compliance with the Rider Law. Uber Eats had already provisioned €136 million for legal liability and continues to face fines related to freelance misclassification.
